Please take time to read the following conditions carefully; they are the basis of the contract between TAC and any school or business utilizing our services and will assist you with your plans.

1. Contract

For all booking of TAC services to any of our China or International locations, the contract is with Foshan Lineng Outdoor Culture Development Co. Ltd.  A contract will only exist when we have received the required deposit and have acknowledged receipt of such in writing by the issue of our official booking confirmation.  The person signing the booking form accepts the following conditions on behalf of all party members and will be the point of contact for further correspondence.

2. Governing Law

The contract is governed by the laws of China and any dispute will be dealt with under the jurisdiction of the courts in China.

3. Payment Terms

3.1 Deposit - Before a booking can be considered confirmed, a ‘party leader’ (the person responsible for the group or party) must complete our booking form in writing and forward the initial 20% deposit for each paying member of the group or party.  The deposit is not refundable.

3.2 Mobilization – 60% of the total booking cost must be paid 30 days before the program’s commencement.

If the mobilization payment is not received by the due date, it will be considered a breach of contract, entitling treatment of the contract as cancelled by you.  Under these circumstances, the contract between us will remain in force until you receive our written notice of cancellation.

3.3 Final Balance Payment – The payment must be settled before the commencement of the course, program or tour.

4. Cancellation

In the event of a cancellation by a paying member of your party 30 days before program commencement, deposit payments may be transferred to a substitute member.  If it is not possible to find a substitute member the initial deposit will be retained by Foshan Lineng Outdoor Culture Development Co. Ltd.

Regarding any cancellations - Foshan Lineng Outdoor Culture Development Co. Ltd. Will retain the total amount paid:

·        20% of program fees 60-30 days before program commencement.

·        40% of program fees 30-7 days before program commencement.

·        80% of program fees less than a week before program commencement.

If any cancellation brings the number of party members below the required minimum to qualify for a particular price, the price will be adjusted accordingly.

5. Price Information and Surcharges

Our prices listed are published in good faith as a guide to the cost of a particular program.  As we tailor-make most of our trips to your requirements the actual cost of a program will be delivered in the form of a quote.

Once you have received the quote it will have validity for a period of time; shown on the quote, if payment is not received by that date the program may be subject to surcharges on currency, unforeseen increases in transportation costs or additional costs resulting from Government action.

6. Alterations or amendments by you

Amendments to your party/group are usually possible at any time up to 1 day before your program.  In the case of domestic or international flights, carrier charges may be applicable.

7. Alterations or amendments by TAC

The details and descriptions written on TAC’s printed materials, brochures and website are in good faith at the date of printing; as plans are made many months in advance, we may occasionally have to make changes, and we reserve the right to do so at any time.  Most changes will be minor and all will be made available at the earliest possible date.  In the unlikely event that we significantly alter or cancel your course/program, we will offer a suitable alternative (if available) or a full refund if we cannot offer a comparable alternative within 14 working days.

TAC, as a provider of goods and/or services, may find it necessary to terminate an activity, whether due to forces of nature, medical necessities, group complications, or other reasons that

TAC, at its discretion, deems prudent.  It is also agreed that TAC may refuse or terminate the participation of any person TAC, in its sole discretion, judges to be incapable of meeting the rigours or requirements of participation in an activity.  All schools and participants accept TAC’s right to take such actions concerning any and all participants.

8. Liability

TAC will only accept responsibility for any injury, illness or death resulting from negligent acts or omission of any servant working on our behalf in the provisions of services to you and whilst acting within the scope of their employment.

Please note that we do not accept liability for any air, sea or land carriers; individual conditions of carriers apply.  We cannot be held responsible for loss of enjoyment or additional expenses due to delays or changes in travel arrangements and/ or other services due to circumstances beyond our control.

9. Acknowledgment of Risks and Assumption of Risks and Responsibilities

TAC, its officers, directors, employees, agents and representatives (all of whom are referred to as “TAC”), take care to provide proper organization, instruction, equipment, risk assessments and supplies for participation in programs and tours organized by TAC.  There are significant elements of risk in discovery and outdoor learning, adventure travel, sports and training associated with the outdoors.  Activities include but are not limited to: white-water and flat kayaking, white-water rafting, bamboo rafting, biking, rock climbing, abseiling, caving, hiking, camping, cooking, surfing, snorkelling, boating, cooperative and leadership games, orienteering and navigation, geo-caching, bouldering, environmental activities, low and high rope courses, and swimming (reoffered herein as “Activity” or “Activities”).  Participants may be housed in dormitories, tents, or other accommodations. Check your program information for activities and details.  TAC mitigates risks by providing appropriate safety equipment (i.e., helmets, PFD, etc.) and appropriate instruction and supervision.

10. Waiver & Release from Liability

In recognition of the various risk relating to Activities which any child, youth or adult will engage in, both foreseeable and unforeseeable, it is expressly confirmed that any child, youth or adult is physically and mentally capable of participating in all Activities and/or using the necessary equipment.  All participants will assume all risk and waive, release and forever discharge TAC from any and all liability, action, causes of action, and damages of whatever kind, including, without limitation: general, special, compensatory and punitive damages, property damage, personal injury, and loss of life, relating to or in connection with any Activity.

11. Medical Authorization

All participants are required to complete the Medical Information Form and/or Registration Form and recognize that TAC will rely upon this information for any treatment or preparation of special needs.  Additionally, all participants are required to hereby agree to authorize any medical treatment deemed necessary in the event of any injury while participating in Activities.  The participant agrees to hold TAC harmless for any and all costs or liabilities incurred.

12. Supervision & Teacher Participation

Teachers will adequately supervise all members of the party.  When applicable, this responsibility is delegated to TAC for activity instruction.  In particular, it is the party leader’s responsibility to ensure:

·        No group member under the age of 18 consumes alcoholic beverages.

·      No student smokes tobacco products during the course/program or behaves in any other way that may cause a fire hazard.

·        All party members follow rules set by TAC during the course/program/tour.

·        No group member breaks the law.

13. Ages and Additional Adults

Program prices are valid for full-time students, aged up to 18 years on the day of departure unless otherwise specified.  Accompanying adults above the ‘free place’ allowance may join the course/program at a discounted rate subject to accommodation availability.  Additional teachers above the ‘free place’ allowance may join the course/program at a discounted rate subject to accommodation availability.

14. Photography

We occasionally employ professional photographers and staff to take pictures for use in TAC promotional material.  If any member of your group wishes NOT to appear in any such photography, please let us know before your course/program and once onsite; please remind the TAC Trip Director of such restrictions.

15. Marketing

TAC may use your written feedback in promotional materials whether it reaches us by email or through a feedback form.  If you do NOT wish to be quoted, please inform us of this on any such written material.
